Terms of use

All persons (the "Users" or individually a "User") visiting the website www.homecredit.net (the "Site") are required to read through and acquaint themselves with this document prior to proceeding to use the Site. Access to and use of the Site by a User is deemed to represent the User's consent to these Terms of Use and any amendments thereto.
These Terms of Use regulate the rights and obligations of the Operator and the Users regarding the use of the Site.
The Site is owned and operated by Home Credit International a. s., having its registered office at Evropska 2690/17, Prague 6, Postal Code 160 41, Czech Republic, recorded in the Commercial Register of the Municipal Court in Prague, Section B, Entry No 2201, Corporate ID: 601 92 666 (the "Operator"), which is authorised to exercise the ownership and intellectual property rights to the Site.

Copyright Notice

The Operator is the owner of any copyright of the Site and its contents, including texts, any page design, technical drawings, graphics, pictures or images posted on the Site, as well as any copyright in the selection and method of arranging the files contained on the Site. Notwithstanding the foregoing, some of the material and text posted by the Operator on the Site (including, but not limited to, trademarks, logos etc.) might be owned by third parties and might be under protection of appropriate legislation on protection of intellectual property rights.
Users are entitled to use the Site and its contents solely for the purposes of their personal and/or non-commercial use. Specifically users are permitted, for the above stated purposes, to retrieve and display the Site and its contents on a computer screen (or on similar devices), to print individual pages on paper (but not photocopy them) and to store such pages in electronic form on disk (however, not on any server or similar storage device connected to a network).
Without prior written permission of the Operator the Users may not, in particular but without limitation, redistribute, copy, further process, modify or retransmit the contents of the Site; remove the copyright and/or trade mark information featured in the contents of the Site or use the contents of the Site for creation of any databases, archives, libraries etc.

Declaration of Accessibility

The Operator declares that this Site aims to provide maximum accessibility of all its contents and functions for all internet users.
The Operator reserves the right to restrict access to certain information ("restricted information") featured on the Site only to Users meeting certain criteria, which may be stated by the Operator on the Site or that may be implied from applicable legal regulation. Users not meeting such criteria must not access such restricted information.
The content of the website conforms to XHTML 1.0 Transitional, the visual aspect of the presentation has been created using CSS 2.

While working on this website, its authors followed methodological guidelines issued by the Czech Ministry of Informatics (Best Practice - Rules for the Creation of Accessible websites, issued on August 25, 2004), recommendations of the principal WCAG 1.0 standard (Web Content Accessibility Guidelines 1.0, issue date May 5, 1999), with special emphasis on the meeting of Priority 1 rules, and the methodological guidelines of the Blind-Friendly Web project, issued by the United Organisation of the Blind and Visually Impaired of the Czech Republic (dated February 4, 2004).

Privacy

Personal Data and Electronic Communication

The Operator may require that access to the Site or certain of its parts or services will be subject to the registration of selected personal information (personal data) by the Users.
Each User wishing to register:

• must provide the Operator with accurate, complete registration information and it is the User's responsibility to inform the Operator of any changes (including, in particular, changes of e-mail address) by e-mailing: info@homecredit.eu. The User should also use this e-mail address for any communication concerning the maintaining and processing of User's personal data and electronic communication (see below for more details).
• may use any information provided via e-mail by the Operator subject to these Terms of Use.
• is responsible for keeping secure any passwords or access codes provided to the User upon registration and/or in order to enable User's access to the content and/or services featured at the Site.
• since, as part of the service for which the User has registered, the Operator may send e-mails to the e-mail address provided by the User, the User warrants that he/she is entitled to receive e-mails at that address, specifically in case such e-mails will be received by the User via a computer network operated by or on behalf of a User's employer or college (or alike). The User agrees that the Operator may refrain from sending any e-mails to such address without notifying the User, even if the User has subscribed to receive them, if the Operator receives a request from the User's employer or college to stop sending e-mails to that address.

User's Consents with Personal Data Processing and Electronic Communication

• The Operator is required, pursuant to Czech Act No. 101/2000 Coll., on the Protection of Personal Data and on Amendments to Other Acts to obtain the User’s consent to maintain and process the User’s personal data provided by the User upon registration. The personal data will be maintained and processed by the Operator for the purpose of regulation of Users’ access to the Site or certain of its parts or services and distributing business news (business-related communication) and information on recent changes in the contents of the Site. The data processing is automated. The User’s consent is voluntary and the User may withdraw his/her consent at any time by sending a notice to this effect to the above stated e-mail address of the Operator.

  By providing the User’s personal data to the Operator the User expresses his/her consent to the fact that his/her personal data will be maintained and processed as set out above. 

  Users have the right to access their personal data and to have it corrected. Users’ other rights are stipulated in Czech Act No. 101/2000 Coll., on the Protection of Personal Data and on Amendments to Other Acts. These rights are briefly summarized as follows:

• (a) If a User discovers or has reason to believe that his/her personal data are processed in violation of the protection of the User’s private and personal life or in violation of the law, especially if such data is inaccurate with respect to the purpose of their processing, the User is entitled:
  • to be given an explanation from the Operator; or,
  • to ask the Operator to remedy such state. Such remedial measures may include blocking, amending, supplementing or deleting the personal data.
• (b) If the Operator fails to satisfy the User’s requirement under paragraph (a), the User may appeal to the Czech Office for the Protection of Personal Data. For more information, please see www.uoou.cz.

• The Operator is required, pursuant to Act No. 480/2004 Coll., on Certain Information Society Services and Amendments to Certain Acts, to obtain the User’s consent to use the User’s electronic address for the purpose of distributing business news (business-related communication) and information on recent changes in the contents of the Site as part of electronic communication. The User’s consent is voluntary and the User may withdraw his/her consent at any time by sending a notice to this effect to the above stated e-mail address of the Operator. 

  By providing the Operator with the User’s electronic address the User expresses his/her consent with the dissemination of business-related communication (including information on the recent changes in the contents of the Site) by the Operator and its affiliated companies to the User as part of the electronic communication between the Operator and its affiliated companies and the User.

• The Users’s consents granted hereunder are acts in law.

Third-Party Web Beacons

We use Third-Party Web Beacons from Yahoo! to help analyze where visitors go and what they do while visiting our website. Yahoo! may also use anonymous information about your visits to this Site, and other websites, in order to improve its products and services and provide advertisements about goods and services of interest to you. Obligations of Users

When using the Site the Users must not: interfere with the Site's security, integrity and operation in general; use the Site for the transfer of damaging files; or, attempt to enter non-public sections of the Site or access restricted information featured on the Site where the Users do not meet the criteria for accessing this information. The User is further required to observe the Operator's copyrights of this Site and, furthermore, to observe the third parties' rights to material and text posted by the Operator on the Site (including, but not limited to, trademarks, logos etc.) but owned by third parties and which is under the protection of appropriate Acts on the protection of intellectual property rights.

The User is fully liable for any risk for his use of this Site and the Operator does not assume any responsibility or liability for such risk. Specifically, the Operator does not assume any responsibility for the contents of any third-party websites that can be accessed through the Site, nor for any obligations of any persons who offer, provide or mediate services or goods on such sites.
To the maximum extent permissible by applicable laws the Operator shall not be liable for any direct, indirect, incidental or consequential damages, including, without limitation, damages for loss of profits, goodwill, loss of data or other intangible losses arising in connection with the use of the Site.

Dispute resolution and governing law

The use of this Site and these Terms of Use shall be governed by Czech law.
Any dispute arising in connection with the use of this Site shall be settled before a court with appropriate local jurisdiction in the Czech Republic and in accordance with Czech law. Should any other court besides a Czech court be approached to hear a dispute arising in connection with the use of this Site, such disputes shall be transferred to and settled at one of the courts of the Czech Republic.
Should any provision of these Terms of Use be held invalid or unenforceable for any reason, the invalid or unenforceable provision shall be severable from the remaining provisions and shall not affect the validity or enforceability thereof.

Changes to Terms of Use

The Operator reserves the right to amend, from time to time, these Terms of Use, by republishing the amended wording of these Terms of Use on the Site. For this reason Users should regularly review these Terms of Use for any changes. Use of the Site after the republication of amended Terms of Use is deemed to represent the User's consent with the amended Terms of Use.

General

Headings used in these Terms of Use are provided solely for ease of use and shall not have any legal meaning or effect.
In case a User disagrees with these Terms of Use (as may be amended from time to time), he/she shall leave the Site and refrain from visiting it in the future.

These Terms of Use shall become valid and effective as of 29 June 2009.
